Mary Lee Obtains Defense Judgment in Complex Public Entity Premises Liability Case

The plaintiffs alleged that a public roadway constituted a dangerous condition which caused a motor vehicle accident resulting in substantial head injuries. Mary Lee successfully argued that no dangerous condition existed, that there was no substantial risk of injury to a user exercising due care, and that no concealed traps existed. Mary Lee additionally argued that the public entity had no ownership, control, or maintenance responsibility over the subject roadway, thus could not be held liable. The Court agreed and dismissed the entire case with prejudice in favor of the public entity.
