Chaena Dade and Catherine Schiff Secure Dismissal with Prejudice for Large Public Entity
Plaintiff alleged negligence and constitutional violations against a large public entity in connection with medical care and treatment received at a local hospital. Ms. Dade and Ms. Schiff obtained dismissal with prejudice of the entire suit filed against our client at the demurrer stage, arguing the state law claims were time-barred by the Government Claims Act and plaintiff could not plead facts to demonstrate a plausible constitutional violation under 42 U.S.C. section 1983.
