Danielle Velazquez and Robert McKenna Win Jury Trial in a Medical Malpractice and Medical Battery Case 

Danielle Velazquez and Robert McKenna obtained a defense verdict in a jury trial in Orange County Superior Court in a case involving medical malpractice, informed consent, and medical battery relative to their client’s performance of a photorefractive keratectomy (PRK) laser vision correction surgery. Plaintiff claimed that he consented to a LASIK laser vision correction procedure, not a PRK laser vision correction procedure, and that irregular healing after the procedure caused him permanent vision issues that required additional procedures and impacted his ability to work as a family medicine physician. After a 3-week jury trial, the jury returned a defense verdict and found that Plaintiff had given informed consent to proceed with the PRK procedure. Damages sought exceeded $1 million.
